1. Acceptance of Terms

By accessing or using the TypeLead platform ("Service"), operated by Atika Solutions ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

TypeLead is an AI-powered B2B lead generation platform that allows users to search for business leads using natural language queries, reveal contact information, organize leads, and run outreach campaigns. The Service operates on a subscription-based model where credits are included with your plan and consumed for specific actions such as revealing contact details.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions, Credits & Payments

  • The Service is offered through subscription plans processed by our payment provider, Whop, who handles payment processing for all transactions.
  • Each subscription plan includes a monthly credit allowance. Credits are consumed when you reveal lead contact details.
  • Credits reset to your plan's monthly allowance at each billing cycle. Unused credits do not roll over.
  • We reserve the right to change subscription pricing at any time; changes will take effect at the next billing cycle.
  • All prices are listed in USD. Applicable taxes are calculated and collected by Whop.

5. Refunds

All payments are processed by Whop. Refunds are governed by Whop's Terms of Service. In summary:

  • Unless required by applicable law, all transactions are non-refundable.
  • If you are located in the EU/EEA/UK, you may have a statutory 14-day right of withdrawal from the date of your transaction.
  • Refund requests should be directed to Whop via the receipt email you received, or through your Whop billing page.
  • If you cancel your subscription, it remains active until the end of the current billing period. No partial refunds are issued for unused time within a billing cycle.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation, including anti-spam, data protection, and privacy laws (e.g., GDPR, CAN-SPAM, CCPA).
  • Scrape, reverse-engineer, or attempt to extract the underlying data or algorithms of the Service beyond what is provided through the normal interface.
  • Share, resell, or redistribute lead data obtained from the Service to third parties.
  • Transmit unsolicited emails (spam) using data obtained from the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated tools (bots, scripts, crawlers) to access the Service without our express written permission.

7. Data Accuracy & Disclaimer

While we strive to provide accurate and up-to-date business information, we do not guarantee the accuracy, completeness, or reliability of any data provided through the Service. Lead data is sourced from publicly available information and third-party providers. You are responsible for verifying data before use. We shall not be liable for any damages arising from reliance on data obtained through the Service.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, and the underlying code — are owned by Atika Solutions and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without explicit written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Atika Solutions and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service, regardless of the theory of liability. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any unused credits in your account at the time of termination may be forfeited. You may delete your account at any time by contacting us at artzymeri2001@gmail.com.

12. Indemnification

You agree to indemnify, defend, and hold harmless Atika Solutions and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Atika Solutions operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the competent courts of that jurisdiction.
